The Fulton County District Attorney’s Office has decided to file charges in the deadly shooting of Rayshard Brooks after officer Brosnan stepped forward to cooperate.
Fulton County D.A. Paul Howard announced the charges of Atlanta Police Officer Devin Brosnan and former police officer Garrett Rolfe. Rolfe is facing 11 charges, including felony murder, multiple counts of aggravated assault with a deadly weapon, first-degree criminal damage to property, and two counts of violating of his oath as a public officer.
If convicted, Rolfe could be sentenced to either life in prison without parole or the death penalty.
The District Attorney, Paul L. Howard, Jr., said this is the first time in history that a police officer chose to speak out against his partner. He said, they first spoke to the officer on June 16th and he decided to become a cooperative witness today, June 17th. The Attorney Howard hopes that by having his cooperation he can move the case forward.
According to attorney Howard, officer Brosnan initially told investigators “the situation was calm but he wasn’t an experienced DUI investigator so that’s why he called officer Rolfe in.” He told investigators he was “surprised it escalated to an arrest” as fast as it did because he thought the situation would be resolved before then. That’s when the officer became emotional and said he needed additional time to explain to investigators his feelings about the shooting that took place.
The attorney also warned of the limitations of charging police saying “I believe we should change the laws, I believe prosecutors should be allowed to charge police officers without a grand jury.”The attorney said its important because without the right to charge officers the virus would stall the process of the indictment until January or February
Attorney Howard said that there are 7 other cases that are scheduled to be presented to grand juries before this one and because of the way law stands they have to wait for a SIGNED indictment for the case to move forward.
